Shifting the Oversight Lens on Cyberspace Operation
Join the U.S. Army Heritage and Education Center (USAHEC) on September 16, 2021, for a live, in-person lecture by Professor Amy C. Gaudion, of Penn State Dickinson Law, as she presents her talk entitled, Shifting the Oversight Lens on Cyberspace Operations. Doors open at 6:00 PM and the lecture begins at 6:30 PM. The lecture will be open to the public or can be live-streamed online for free at www.armywarcollege.edu/live.
Seating is limited to 150 visitors and masks are required. Online viewers can participate in the Q/A portion of the event by submitting questions via email or direct message on the USAHEC Facebook Page.
In this lecture, Professor Gaudion examines the recent expansion of the U.S. government's cyber authorities, to engage in both offensive and defensive measures, and explains how that expansion has coincided with a weakening and dispersion of congressional oversight mechanisms. This combination inhibits Congress's ability to gain a comprehensive understanding of the use of these new cyber capabilities and obscures the use of such powers from the public as well. Professor Gaudion proposes alternative mechanisms for plugging the gaps in the oversight structure and for ensuring appropriate limits on the use of cyber capabilities, considering their potential for unintended escalation, catastrophic effects, harm to third parties, damage to diplomatic relationships, and the development of reciprocal state actions at odds with the goal of creating international norms in cyberspace.
Professor Gaudion is the Associate Dean for Academic Affairs and Professor of Lawyering Skills at Penn State Dickinson Law. Her teaching and scholarship focus on cyberspace law and policy, national security law, and civilian-military relations. She leads Dickinson Law's national security and cyberspace programs, including an annual cyberspace simulation exercise in collaboration with the U.S. Army War College. Gaudion participated in the 2021 U.S. Army War College National Security Seminar.
